Welcome to the Green Map website. By using our Website, you indicate your unconditional acceptance of the following Terms of Service. Please read them carefully, as they may have changed since your last visit. We reserve the right, at our discretion, to modify, add or remove portions of these Terms. Such modifications shall take effect immediately upon posting the modified Terms to the Website. Your continued use of the Website after the posting of changes to these Terms will constitute your acceptance of those changes.
The Green Map Website, located at GreenMap.org, is a copyrighted work belonging to Green Map System. Certain features of the Site may be subject to additional guidelines, terms, or rules, which will be posted on the Site in connection with such features. If you violate any of these Terms, you automatically forfeit your right to use the Website, regardless of any actions we take or don’t take to enforce such forfeiture.
These Terms of Service describe the legally binding terms and conditions that govern your use of the Website. BY LOGGING INTO THE SITE, YOU ARE BEING COMPLIANT WITH THESE TERMS, and you represent that you have the authority and capacity to enter into these Terms. IF YOU DISAGREE WITH ANY OF THE PROVISIONS OF THESE TERMS, DO NOT LOG IN TO AND/OR USE THE SITE.
This Website is intended for a general audience and does not provide specific features or services targeted at children under the age of 13. We do not knowingly solicit personal information regarding children under age 13, as stated in the COPPA guidelines.
These terms require the use of arbitration on an individual basis (see 2.5 below) to resolve disputes and also limit the remedies available to you in the event of a dispute.
1. Scope of Services
To encourage inclusive participation in sustainable community development, the Green Map System provides the public with access to Green Maps, which are locally authored maps that use Green Map Icons to indicate natural, cultural, social, and/or sustainability sites, routes, and resources (“Green Map”). A Green Map may be printed, digitised, or created in other formats, including but not limited to an interactive Green Map ("Green Map" or “Map”) created with our Green Map mapmaking Website (“Website” or “Site”).
Visitors to this Website ("You") are responsible for obtaining any necessary equipment and Internet service to access our Website. They must pay any fees associated with the equipment and service you select. We may alter, suspend, or discontinue this Website in whole or in part, at any time and for any reason, without notice. The Website may also become unavailable periodically due to maintenance, computer equipment malfunctions, or other reasons.
Green Map System grants you a non-transferable, non-exclusive, revocable, limited license to access the Site solely for your own personal, noncommercial use.
2. User Content
2.1. "User Content" or “Content” means any and all information and content that a user submits to or posts on the Site (e.g., text, images, photos, videos, map data, and comments).
2.2. User Responsibility and Warranties. You are exclusively and solely responsible for your User Content. You bear all risks associated with the use of your User Content, including any reliance on its accuracy, completeness, or usefulness by others, or any disclosure of your User Content that personally identifies you or any third party.
You hereby warrant (promise) that you own or have all necessary rights, licenses, consents, and permissions to use and to authorise Green Map System to use your User Content as described herein. You may not represent or imply to others that your User Content is in any way provided, sponsored or endorsed by Green Map System. Because you alone are responsible for your User Content, you may expose yourself to liability. You further warrant that your User Content does not and will not violate our Acceptable Use Policy or any third-party rights, including but not limited to copyright, trademark, privacy, or publicity rights.
You may not represent or imply to others that your User Content is in any way provided, sponsored, or endorsed by Green Map System. Because you alone are responsible for your User Content, you may expose yourself to liability if, for example, your User Content violates the Acceptable Use Policy.
Green Map System is not obliged to backup any User Content, and your User Content may be deleted at any time without prior notice. You are solely responsible for creating and maintaining your own backup copies of your User Content if you desire.
2.3. License Grant. Unless otherwise specified, all User Content is licensed under the Creative Commons Attribution-NonCommercial-NoDerivatives 4.0 International (CC BY-NC-ND 4.0) license: https://creativecommons.org/licenses/by-nc-nd/4.0/ . Users can add a specific license to each of their Maps on the Website, which applies to all User Content associated with their Maps. In case such a license is added at the Map level, that license supersedes the CC BY-NC-ND 4.0 license for all User Content associated with that Map.
We do not claim ownership of Content submitted by users without compensation from Green Map System and made publicly accessible through our Website. By submitting such Content, however, you agree to grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, distribute, reproduce, modify, adapt, create derivative works from, and publicly perform or display such Content. This license shall remain in effect until we delete the Content from our systems.
Contributors retain all rights to all Content they post. We are not responsible for protecting the rights of any Contributor to his or her Content, and Contributors are not entitled to our assistance in protecting such Content.
All Contributors irrevocably grant Green Map System and its representatives, affiliates, licensees and assigns the absolute right and permission to use in any manner or form the Content in conjunction therewith for any lawful purpose.
All Contributors further waive any right to inspect or approve the use of the Content and understand that Green Map System shall not be obligated in any way to compensate or make any payment for the uses described herein.
All Contributors warrant that they have full and complete power to grant the rights herein granted; and, that all text in the material is true and accurate and reflects personal observations and opinions; and, that he/she holds Green Map System and its representatives, affiliates, licensees and assigns harmless from any and all claims that may arise out of the use of the Content.
2.4. Acceptable Use Policy. The following terms constitute our "Acceptable Use Policy": You agree not to use the Site to collect, upload, transmit, display, or distribute any User Content (i) that violates any third-party right or any intellectual property or proprietary right; (ii) that is unlawful, harassing, abusive, tortious, threatening, harmful, invasive of another’s privacy, vulgar, defamatory, false, intentionally misleading, trade libelous, pornographic, obscene, patently offensive, promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual; (iii) that is harmful to minors in any way; or (iv) that is in violation of any law, regulation, or obligations or restrictions imposed by any third party.
In addition, you agree not to: (i) upload, transmit, or distribute to or through the Site any software intended to damage or alter a computer system or data; (ii) send through the Site unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of duplicative or unsolicited messages; (iii) use the Site to harvest, collect, gather or assemble information or data regarding other users without their consent; (iv) interfere with, disrupt, or create an undue burden on servers or networks connected to the Site, or violate the regulations, policies or procedures of such networks; (v) attempt to gain unauthorized access to the Site, whether through password mining or any other means; (vi) harass or interfere with any other user’s use and enjoyment of the Site; or (vi) use software or automated agents or scripts to produce multiple accounts on the Site, or to generate automated searches, requests, or queries to the Site.
2.5. Enforcement. We reserve the right to review any User Content, and to investigate and/or take appropriate action against you in our sole discretion if you violate the Acceptable Use Policy or any other provision of these Terms or otherwise create liability for us or any other person. Such action may include removing or modifying your User Content, terminating your Account in accordance with Section 8, and/or reporting you to law enforcement authorities.
THE PARTIES HEREBY WAIVE THEIR CONSTITUTIONAL AND STATUTORY RIGHTS TO GO TO COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY, instead electing that all claims and disputes shall be resolved by arbitration under this Arbitration Agreement. Any controversy between the parties hereto involving any dispute arising from the fulfillment of the Services herein, on written request of one party served on the other, shall be mediated to the satisfactory conclusion of all issues and should that mediation not be successful, it shall then be submitted to binding arbitration in New York, NY with one arbitrator mutually approved by the parties and such arbitration shall comply with and be governed by the provisions of JAMS, or similar arbitration association, and judgment upon the reward rendered by the arbitrator may be entered in any court having jurisdiction thereof. Without limitation of the foregoing, the decision of the arbitrator shall be final and binding. In the event of mediation or arbitration under this agreement, the prevailing party shall be entitled to recover its reasonable costs and expenses, including reasonable attorneys’ fees.
2.6. Feedback. Suppose you provide Green Map System with any feedback, images or suggestions regarding the Site. In that case, you hereby assign to Green Map System all rights in such Feedback and agree that Green Map System shall have the right to use and fully exploit such Feedback and related information in any manner it believes appropriate. The Green Map System will treat any Feedback you provide as non-confidential and non-proprietary.
3. Copyright Policy
Green Map System respects the intellectual property of others and asks that users of our Site do the same.
3.1. Notice and Takedown. We reserve the right, in our sole discretion, to remove any User Content that we believe may infringe upon the copyright or other intellectual property rights of a third party, with or without notice to the user who posted it.
If you believe that your copyrighted work has been copied and posted on our Site in a way that constitutes copyright infringement, please provide us with the following information:

The specific URL or location on our Site where the infringing material is located;

3.2. Repeat Infringer Policy. Green Map System has a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers.
4. Indemnification
You agree to indemnify and hold Green Map System and its officers, employees, and agents harmless, including costs and attorneys’ fees, from any claim or demand made by any third-party due to or arising out of (a) your use of the Site, (b) your violation of these Terms, (c) your violation of applicable laws or regulations, or (d) your User Content (including, but not limited to, claims of copyright infringement or violation of other intellectual property rights). Green Map System reserves the right to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims. You agree not to settle any matter without the prior written consent of Green Map System. Green Map System will use reasonable efforts to notify you of any such claim, action or proceeding upon becoming aware of it.
5. Our Intellectual Property and Icon Use
5.1. Green Map Icons (CC BY-NC-SA +CC). Our nonprofit, Green Map System, Inc. has re-licensed the once-copyrighted Green Map Icons, v3 for use under the Creative Commons BY-NC-SA 4.0 license (+CC). This "Attribution - NonCommercial - Share Alike" license means you can freely use, adapt, and share the Green Map Icons on non-commercial projects of any kind, provided that you give credit to Green Map System and share your project under the same license terms.

5.2. Green Map Logo (Trademark). The Green Map logo is a trademark of Green Map System, Inc. in the United States, the European Community, and Taiwan. This trademark is not licensed under Creative Commons. You may request a limited, one-year license to use the logo by contacting us.
5.3. Citation and Use Policy.

Non-Commercial Use: Permission is granted to use and copy Green Map documents for any non-commercial use, provided that the name "Green Map System" is not used in advertisements without specific permission and proper credit is given.

Commercial Use: Any commercial use of documents, icons, or logos requires a separate license and fee.
